  5. their related documentation, utilities, and examples

  8. These Files and their related documentation, utilities, and examples
  9. are provided "AS-IS" and subject to change without notice; no warranties
  10. are made.  All use is at your own risk.  No liability or responsibility
  11. is assumed.

  13. A. DISTRIBUTION OF UNMODIFIED INSTALLER-NG DEVELOPER ARCHIVE

  15. The complete and unmodified InstallerNG archive, as provided
  16. by Jens Tröger, may be freely redistributed via any means which preserves
  17. its copyrights.  The archive may not be sold for profit. If spread
  18. via an official persistent media (e.g. disk or CD-ROM) or any magazine,
  19. no matter if this is electronical or "classic" or whatever, the author,
  20. Jens Tröger, has to be notified. Furthermore, you must send a copy
  21. of this release to the author.

  23. B. DISTRIBUTION OF INSTALLER-NG

  25. Specific Files from the archive may be reproduced and distributed
  26. separately under license subject to agreement with the following terms
  27. and conditions (wherein the reference to Files shall mean InstallerNG and
  28. the InstallerNG project icon, either individually or collectively):

  30. 1.   The Files may be reproduced but must not be modified in any way.
  31.  
  32. 2.   The Files may only be distributed as an integral part of a software
  33.      product solely for AMIGA computers.
  34.  
  35. 3.   The related documentation, utilities, and examples provided by
  36.      Jens Tröger may not be reproduced or distributed, in whole or in part,
  37.      except as part of a complete and unmodified archive as provided by
  38.      Jens Tröger.

  40. 4.   Licensee shall hold Jens Tröger harmless from any and all claims,
  41.      damages and liabilities resulting from or arising out of its use or
  42.      distribution of the Files.

  44. 5.   All copies of Licensee's software product containing the Files and
  45.      of Licensee's product documentation related thereto (either paper
  46.      or electronic) must include the following copyright notice:

  52. 6.   Licensee's product documentation (either paper or electronic) must also
  53.      include a disclaimer substantially similar to the following:

  55.      INSTALLER-NG SOFTWARE IS PROVIDED "AS-IS" AND SUBJECT TO CHANGE;
  56.      NO WARRANTIES ARE MADE.  ALL USE IS AT YOUR OWN RISK.  NO LIABILITY
  57.      OR RESPONSIBILITY IS ASSUMED.

  59. 7.   Licensee may only distribute the versions of the Files that have
  60.      been approved by Jens Tröger for electronic licensing as evidenced
  61.      by Jens Tröger's inclusion of the Files in an official archive or
  62.      diskette containing the Files, the related documentation, utilities,
  63.      and examples, and this Electronic License Agreement. Ongoing
  64.      distributions must include only the most recently approved releases
  65.      of the Files which Jens Tröger has designated for electronic licensing
  66.      and distribution.

  68. 8.   The Files may not be installed on a user's system or Workbench
  69.      unless the installation procedure included with Licensee's product has
  70.      determined that the user's system or Workbench does not contain a more
  71.      recent version of the Files.

  73. 9.   Such technical information as is contained in the Files (and any
  74.      product thereof) or in the related documentation, utilities, and
  75.      examples may not be exported in contravention of the laws and
  76.      regulations of the Federal Republic of Germany.

  78. 10.  Prior to any distribution of the Files, Licensee must acknowledge and
  79.      consent to these terms by forwarding a completed and signed copy of
  80.      this entire Agreement, on paper, to:

  83. 11.  Jens Tröger may terminate this license at any time, with or without
  84.      cause. This license and Licensee's rights hereunder will automatically
  85.      terminate upon any breach of these terms and conditions. Upon any such
  86.      termination, Licensee shall destroy all copies of the Files and the
  87.      related documentation, utilities, and examples in its possession.
